FORGE.MQL5.IO Terms of Use

Please read these Terms of Use carefully before using the forge.mql5.io website ("Forge Service"). By accessing or using the site, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms of Use constitute a legally binding agreement between you and MetaQuotes Ltd.

1. Definitions

Term	Meaning
MetaQuotes Ltd	The company that owns and operates the forge.mql5.io website.
Forge Service / MQL5 Algo Forge	An online platform providing collaborative development tools, Git repository hosting, and social features for developers of algorithmic trading systems.
User ("you")	Any individual or legal entity using the Forge Service under these Terms.
MQL5 Account	A unified user account required for accessing MQL5 services, including Forge.
Repository	A Git-managed storage space for source code, documentation, and related files.
Content	Any information uploaded, published, or otherwise shared via the Forge Service, including source code, text, images, etc.
Open License	A license allowing use, modification, and redistribution of source code (e.g., MIT, GPL, Apache 2.0).

2. General Provisions

2.1. The Service is intended for users aged 18 and above. Use by minors is strictly prohibited.

2.2. You accept these Terms by either:

• clicking "Create repository", "Register", "Accept", or a similar action button; or
• using any functionality of the platform.

2.3. These Terms are supplemented by the Privacy Policy.

3. Registration and Access

3.1. A valid MQL5 ID account is required to create repositories. You must provide accurate and up-to-date information and update it as needed.

3.2. MetaQuotes Ltd reserves the right to suspend or terminate access to the Forge Service (to you individually or to all users) without prior notice if deemed necessary for security or legal compliance.

4. Use of the Forge Service

4.1. Acceptable use. You may not:

• publish malicious, unlawful, or third-party-infringing code;
• upload content containing viruses, backdoors, miners, or other harmful components;
• engage in spam, phishing, or other fraudulent activity;
• disrupt or attempt to disrupt the Forge infrastructure. 

Violations may result in repository or account suspension.

4.2. Code Publishing

• By default, repository content is public and indexed by search engines. For private projects, use the "private repository" option if available.
• You must specify the license terms (e.g., in a LICENSE file). If no license is provided, the project is treated as "all rights reserved", which limits the community in using your project.
• By uploading content, you grant MetaQuotes Ltd a non-exclusive license to store, back up, display, and process it as necessary for platform operation. You retain full copyright.

4.3. Use of Third-Party Code If you include third-party libraries or code, you are responsible for complying with their licenses and obtaining necessary permissions.

4.4. You may not use the Forge Service, its technologies, or knowledge gained through the platform to develop competing services or products related to algorithmic trading, MQL application development, or similar fields in which MetaQuotes Ltd operates.

4.5. You are strictly prohibited from decompiling, disassembling, reverse engineering, analyzing the source code, or creating derivative works based on the Forge software without prior written consent from MetaQuotes Ltd.

6. Privacy and Personal Data

6.1. Personal data is processed in accordance with the MQL5 Privacy Policy published at mql5.com. You consent to the transfer and storage of your data on servers located in any jurisdiction chosen by MetaQuotes Ltd, subject to applicable data protection laws.

6.2. By using the Service, you expressly consent to the processing of personal data for the purposes of service delivery, usage analytics, feature improvement, and security. This consent may be withdrawn via the Service interface at any time.

6.3. Personal data may be stored and processed on servers in any jurisdiction selected by MetaQuotes Ltd, with full adherence to applicable data protection requirements.

7. Intellectual Property and Trademarks

7.1. All rights to the Forge software, design, and logos are owned by MetaQuotes Ltd or licensed from third parties and protected under international law. These Terms do not grant you any rights to use MetaQuotes Ltd's trademarks without prior written consent.

7.2. You retain all rights to your own Content. By uploading it to Forge, you confirm that you have the necessary rights and that it does not infringe upon third-party rights.

7.3. MetaQuotes Ltd reserves the right to monitor usage of the Service, including repository content, to ensure license compliance and detect intellectual property violations. Пользователь согласен на автоматизированное сканирование контента для таких целей.

8. Limitation of Liability

8.1. The Forge Service is provided "as is", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or uninterrupted operation.

8.2. MetaQuotes Ltd is not liable for:

• any indirect damages or loss of profit resulting from use or inability to use the Service;
• data loss due to user actions or third-party interference;
• content published by users.

8.3. When using the Service in jurisdictions with specific requirements for data protection, export control, or intellectual property laws, you agree to comply with all applicable local regulations in addition to these Terms.

8.4. MetaQuotes Ltd may implement technical security measures, including authentication systems, activity monitoring, and feature restrictions in cases of suspected violations. Circumvention of such measures is strictly prohibited.

9. Indemnification

You agree to indemnify and hold MetaQuotes Ltd harmless from any claims, losses, or damages arising from:

• your breach of these Terms;
• content you upload that violates copyright or other rights of third parties.

10. Changes to Terms

MetaQuotes Ltd may modify these Terms at any time. Updated versions will be published on forge.mql5.io and will take effect immediately upon publication. Continued use of the Service constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

11.1. These Terms and any disputes arising out of or relating to them are governed by the substantive laws of the Republic of Cyprus, without regard to conflict of law principles.

11.2. You and MetaQuotes Ltd irrevocably submit to the exclusive jurisdiction of the courts of the Republic of Cyprus. However, MetaQuotes Ltd reserves the right to seek injunctive relief in any competent jurisdiction.
